Terms and conditions
The following Terms and Conditions apply to all donations, deliveries, offers and services by the Swiss Intensive Care Medicine Foundation. Verbal agreements will not take legal effect. The Terms and Conditions take precedence over any purchasing and ordering conditions.
Specifics regarding donations
The Swiss Intensive Care Medicine Foundation is included on the canton of Basel-Stadt’s donation list and will be recorded in the tax register as a tax-exempt charitable institution.
Your donation finances the work of the Swiss Intensive Care Medicine Foundation, which includes promotion of educational work about intensive care medicine, providing patients and dependents with information and advice about intensive care treatment, and supporting and acknowledging research and development projects in the field of patient-centred intensive care medicine in Switzerland.
Your donation represents a unilateral undertaking to transfer a specific value to the Swiss Intensive Care Medicine Foundation for fulfilment of its purpose.
Donations to the Swiss Intensive Care Medicine Foundation can be claimed against direct Federal tax and cantonal and municipal taxes when the tax law requirements in the canton where you are resident or have your domicile are fulfilled.
You can make a donation at your bank using a paying-in slip, by credit card, bank transfer (IBAN CH14 0029 2292 1804 8701 H) and by telephone (on +41 61 561 53 65, Monday to Friday, from 08:00 to 17:00).
We accept the following credit cards: VISA/MasterCard, Postcard and TWINT. Your credit card details will be transmitted by SSL encryption. Each transaction will be authorised online with the competent credit card companies. We will not store your credit card number.
Please note that you can only claim back a voluntary donation under exceptional circumstances.

Changes to webshop prices and products
The Swiss Intensive Care Medicine Foundation offers various products via its webshop, which are shipped to Switzerland and also abroad, for a fee.
All prices are shown in Swiss francs (CHF) including value added tax. The Swiss Intensive Care Medicine Foundation reserves the right to amend prices. All offers are non-binding. The right to Internet printing errors and incorrect information is also reserved.
The prices listed in the webshop are binding and exclude packaging and shipping. The customer will bear the cost of packaging and shipping.
Webshop payment options
You can pay against invoice within 30 days net, by VISA/MasterCard or Postcard credit cards, or TWINT. Your credit card details will be SSL-encrypted and transmitted to Datatrans. Every transaction will be authorised online by the competent credit card companies. We will not store your credit card number.
All payments are to be made in Swiss francs to the Swiss Intensive Care Medicine Foundation itself or to a paying agent designated by it. Payments will only be deemed to have been made if the Swiss Intensive Care Medicine Foundation can dispose of them freely.
If customers fail to comply with the payment terms they will immediately be in default and the Swiss Intensive Care Medicine Foundation will not issue a reminder. The customer will be obliged to pay default interest at 5% above the Swiss National Bank discount rate.
The customer can only offset counterclaims if these claims are directed against the Swiss Intensive Care Medicine Foundation itself, are uncontested, acknowledged or legally enforceable and the Swiss Intensive Care Medicine Foundation agrees to offsetting.
The Swiss Intensive Care Medicine Foundation is not bound by prices from previous orders for new orders (subsequent orders).
Webshop delivery and shipping
Delivery will be made within Switzerland and abroad by agreement. The costs for shipping and packaging the delivery will be based on the dispatch method. The delivery period is 10 days if in stock. The delivery period commences following receipt of all the information from the customer required for executing the order and, if agreed, payment of a deposit or advance payment in full. The stated delivery period will only apply after receipt of the deposit/advance payment, if such has been agreed.
You will be notified if items are currently unavailable for delivery.
Goods will only be supplied to customers who are minors upon payment in advance. The goods will remain the property of the Swiss Intensive Care Medicine Foundation until payment in full is received.
The delivery periods stated by the Swiss Intensive Care Medicine Foundation are non-binding unless it has designated them in writing as such.
The Swiss Intensive Care Medicine Foundation is entitled to make partial deliveries or deliveries in advance. Any part delivery can be invoiced separately.
The delivery period will be prolonged accordingly by the customer’s change requests, as well as unforeseeable and unavoidable events for which the Swiss Intensive Care Medicine Foundation is not responsible, such as force majeure, strikes and lockouts, business disruption, difficulties obtaining materials and energy, transport delays, energy and raw material shortages, official action and difficulties obtaining permits, especially import and export licences. This will also apply if the problems occur with an upstream supplier; the right to correct and timely self-delivery is reserved. If the delay is more than temporary, both parties are entitled to cancel the contract. In this case neither party can claim compensation.
Place of performance
The place of performance for delivery is the domicile of the Swiss Intensive Care Medicine Foundation.
Transfer of benefit and risk
Benefit and risk transfer upon handover to the customer or a shipping company at the place of performance.
If dispatch is delayed as a result of circumstances for which the customer is responsible, risk will pass to the customer upon notification of dispatch readiness.
Warranty
Defects, differences in quantities and incorrect deliveries must be notified in writing to the Swiss Intensive Care Medicine Foundation immediately they are discovered, but at the latest five days after receipt of the goods, and immediately they are discovered in the event of concealed defects. The warranty entitlement will lapse if complaints concerning defects are received late. All claims based on the warranty shall lapse within two years of transfer of benefit and risk to the customer.
Liability
The Swiss Intensive Care Medicine Foundation will not be liable for its actions and omissions arising from slight negligence.
The Swiss Intensive Care Medicine Foundation will not be responsible for actions or omissions that can be attributed to auxiliaries. Mandatory statutory liability provisions are reserved.
Data protection
The operators of these pages take protection of your personal data very seriously. Customer data supplied when ordering will not be passed to other companies. The customer data will remain the property of the Swiss Intensive Care Medicine Foundation and will be treated confidentially. We handle your personal data in confidence and in accordance with the statutory data protection provisions and our Privacy Policy.
Severability clause
Should individual provisions or parts of these Terms and Conditions prove to be void or ineffective, this will not otherwise affect the validity of the Terms and Conditions.
Applicable law and jurisdiction
The provisions of Swiss law apply, excluding the UN Convention of 11 April 1980 on Contracts for the International Sale of Goods. The sole jurisdiction for all claims in connection with your donations or orders will be Basel, Switzerland.
